The facility failed to report the program data eletronically on the California Environmental Reporting System(CERS). The owner or operator shall declare that the facility is a hazardous waste generator and enter the facility EPA ID number in the business activities section in CERS. This is a Class II violation. 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. Several oil stains were found on the pavement of the facility, underneath several vehicles, underneath a silver tool box on the south-east side of the shop, and around a floor drain near the used oil storage area in the back of the shop. Metal shavings were found not contained on the rotor resurfacing machine. Facilities shall be maintained and operated to minimize the possibility of a fire,explosion, or release of hazardous waste to air, soil, or surface water which could threaten human health or the environment. Immediately clean the oil stains, containerize the metal shavings, and manage according to Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was managed. This is a minor violation. 402 CCR 66262.34(d)(2) Failed to store hazardous waste in a compatible container. Metal shavings were found not Contained on the rotor resurfacing machine located on the south-east side of the shop. Wastes shall be stored in a container made of or lined with materials which will not react with, and are otherwise compatible with,the hazardous waste to be transferred or stored,so that the ability of the container to contain the waste is not impaired. Immediately transfer the metal shavings to a compatible container. This is a Class II violation. 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. A blue poly 30 gallon container with used oil residue located at the back of the shop was found without a cap.All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately close these containers and ensure all hazardous waste containers are closed when not adding or removing waste. This is a minor violation. 601 CCR 66262.34(d)Stored hazardous waste onsite greater than 180 days. Metal shavings were not contained found on the rotor resurfacing machine. Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days.
