RECEIVED <br />In your inspection report, you state that violations 122, 123, and 124 are repeat violations. <br />These were not violations at all, as the generator did retain a copy of the manifest signed <br />by the Treatment, Storage and Disposal Facility (attached). Also, since each event is a <br />discreet and separate event, failing to keep a copy of the manifest signed by the TSDF is <br />not a repeat violation unless the specific manifest was not kept, the status of the waste for <br />that specific manifest was not determined within 35 days, or an exception report for that <br />specific manifest was not filed within 45 days; repeat violations are not separate manifest <br />violations, just as generator violations are not repeat violations unless they are for the <br />exact same container — they are separate violations. <br />I hope this resolves all of the outstanding issues.
