Box 388 <br />Stockton, CA 95201-0388 <br />Dear Mr. Yoshioka: <br />Burlington North to Fe <br />Environmental & Hazardous Materials <br />740 East Carnegie Drive <br />San Bernardino, CA 92408-3571 <br />(909)386-4082 <br />March 20, 1997 <br />File: 01001836 <br />Reference is made to your inspection report for The Burlington Northern and Santa Fe <br />railyard (BNSF) at 801 Diamond Street in Stockton, California, dated January 27, 1997. <br />The items noted in your inspection have been addressed as follows: <br />Manifests - 30 -day Copy, Section 66262.23 (a)(4)(CCR) <br />BNSF is contracted to a limited number of transporters who are kept up-to-date on our <br />manifesting procedures which include using the above address as the generator address <br />and sending all generator copies to my attention for further handling. Manifest <br />No. 95343242 was an emergency situation involving a transporter who was used only on <br />this one incident. Even though our facility personnel are aware of general manifesting <br />procedures, they do not deal with manifests frequently enough to have mastered the <br />details of what is a fairly complex tracking system. I have discussed what happened <br />with the facility supervisors and will emphasize manifesting procedures at my next <br />annual training. <br />The regulations do not appear to specify a requirement for exception reporting upon <br />failure to submit a 30 -day manifest copy. We have called the Department of Toxic <br />Substance Control (DISC) twice but have not received a response on this matter. Since <br />we have the disposal facility copy (attached), we will take no further action on this <br />matter. <br />• Status of Hazardous Waste, Section 66262.42 (a)(CCR) <br />According to our records, all disposal facility copies have been received. The TSDF <br />copy for manifest No. 95936892 (attached) was received and should have been in <br />Section 8 of our on-site Business Plan. I am not certain why this manifest was not <br />located onsite suring your inspection, but I will sed another copy to the facility. <br />
