0 0 <br />Lisa Brown <br />Circuit Works Warrant Inspection <br />Page 3 <br />Ms. Ratliff and I placed our ice chest in the trunk of our car and left the site. We took the <br />samples to Roy F. Weston Laboratory for analysis, but they refused to analyze any <br />samples that would result in a "court case", so we left that facility and took the samples <br />to FGL for analysis. FGL accepted the samples and signed off the chain of custody. <br />As a result of that inspection, violations of the hazardous waste statutes and/or <br />regulations were identified. Specific violations are listed below. <br />REPORT OF VIOLATIONS: <br />1. Part 261.5 (a) and (g), 40 Code of Federal Regulations. At the time of <br />inspection, a container with a capacity of approximately 1000 gallons was <br />contained unlabelled RCRA waste and the facility did not have a RCRA <br />permit. <br />2. Section 25189.5, California Health and Safety Code. At the time of <br />inspection, a sludge -like material was disposed of to the ground. <br />3. Section 66262.34 (a), California Code of Regulations (CCR). At the time of <br />inspection, several 55 -gallon drums containing hazardous waste were <br />unlabelled. <br />6. Section 66265.173 (a), CCR. At the time of inspection, two 5 -gallon <br />buckets, one white bag, two 55 -gallon drums and one vat of hazardous <br />waste were not covered. <br />7. Section 66262.34 (f), CCR. At the time of inspection, several drums <br />containing hazardous waste had an unreadable, or no "date of <br />accumulation". <br />8. Section 66262.34 (c), CCR. At the time of inspection, several drums <br />containing hazardous waste had been stored beyond 90 days without an <br />interim status permit. <br />
