C. Determine if an immediate response action is needed at . <br />the site; <br />d. Identify possible remedies for the site; and <br />e. Assess and provide for the informational needs of the <br />community surrounding the site. <br />3.2 PEA Guidance & Reports. The investigation shall be <br />designed to meet the objectives set forth in Paragraph 3.1. The <br />investigation shall, at a minimum, be based upon and be <br />consistent with the Comprehensive Environmental Response, <br />Compensation, and Liability Act of 1980, 42 U.S.C. Section 9601 <br />et seq. as amended, the National Oil and Hazardous Substances <br />Pollution Contingency Plan, 40 C.F.R. Section 300 et seq. (NCP). <br />The investigation shall be based upon DTSC's "Preliminary <br />Endangerment Assessment Guidance Manual," and any other guidance <br />documents provided to Project Proponent by DTSC pursuant to this <br />Agreement. <br />Documents to be prepared under this Agreement are: <br />a. A PEA Workplan, which shall include a sampling plan <br />designed to characterize the type and extent of <br />contamination at the site; a health and safety plan <br />addressing health and safety issues and safe work <br />practices; and a quality assurance/quality control plan <br />to produce data of known quality. <br />b. A Draft PEA Report -which will document whether a <br />release or threatened release has occurred, the threat <br />the site poses to human health and the environment, and <br />whether further action is necessary. <br />C. A Final PEA Report which will incorporate DTSC's <br />comments and requirements. <br />3.3. DTSC Oversight. <br />3.3.1 Prior to the finalization of this Agreement DTSC has <br />expended staff resources to accomplish -activities including but <br />not limited to the following: <br />a. Met with the Project Proponent regarding the nature of <br />the site and the scope of work; <br />3 <br />
