b. Conducted activities necessary to prepare this <br />Agreement; <br />C. Reviewed the Site Cleanup and Sampling Summary Report, <br />Applied Science and Engineering, Inc., August 31, 1994, <br />in order to obtain background information regarding the <br />Site; <br />d. Conducted site visits to meet with Mr. Kyle West and <br />San Joaquin County representatives to collect <br />background information and visually inspect the site; <br />and - <br />e. Reviewed the Supplemental Sampling Plan, Applied <br />Science and Engineering, Inc., December 22, 1994. <br />3.3.2 DTSC shall review and provide Project Proponent with <br />writtencommentson all Project Proponent deliverables and as <br />appropriate other documents applicable to the scope of the <br />project. The comments may be of any form and length determined <br />appropriate by DTSC. <br />3.3.3. DTSC shall provide oversight of field activities <br />including sampling and remedial activities. <br />3.3.4. DTSC's completion of activities described in <br />Paragraphs 3.3.2 and 3.3.3 shall constitute DTSC's complete <br />performance under this Agreement. <br />3.4. DTSC Review. If DTSC determines that any report, <br />plan, schedule or other document submitted for approval pursuant <br />to this Agreement fails to comply with this Agreement or fails to <br />protect public health and safety or the environment, DTSC may: <br />a. Return comments to the Project Proponent with <br />recommended changes and a date by which the Project <br />Proponent must submit to DTSC a revised document <br />incorporating the recommended changes; or <br />b. Modify the document as deemed necessary and approve the <br />document as modified. <br />3.5. Payment. Notwithstanding any provision of H&SC section <br />25201.9, Project Proponent agrees to pay (1) all costs incurred <br />by DTSC in association with preparation of this Agreement and <br />4 <br />
