Empty containers that
previously held a hazardous material are not a hazardous waste as long as they meet
this definition of "empty" and the following management practices are followed:
• Make sure that no material can be poured or drained from the container when the
container is tilted or inverted (i.e., turned up -side -down).
• Make sure the container is empty by either scraping or otherwise physically
emptied (a thin uniform layer is considered acceptable).
• It is recommended that you return containers to the supplier for reuse or find
someone who would buy them or take them as scrap metal or recondition them
for reuse.
• All empty containers must be stored to prevent collection of storm water in the
containers.
Note: Some materials contain no hazardous ingredients. Check the SDS. These drums
are not regulated, however they should not be put whole into the regular trash. These
containers may be re -used, for example as trashcans. If they are placed in the trash,
remove and destroy the labels.
In California, the following additional requirements apply:
Containers of 5 gallons or less: Once empty, these containers can be reused
onsite, recycled as scrap metal (if they are made of metal), or disposed of in the
regular trash, but only after removing or painting over the label. It is
recommended that you return these containers to the supplier for reuse or find
someone who would buy them or take them as scrap metal or recondition them
for reuse.
• Containers larger than 5 gallons: Apply a label with the words "empty" and the
date when it last held a hazardous material or waste. Within one year, these
containers must be sent offsite to be recycled as scrap metal or reconditioned/re-
Boretech Hazardous Materials & Hazardous Waste Management Operations Plan Page 130
