Offered custody of hazardous waste to an unregistered transporter. When Mr. Proctor was asked <br /> whom he uses as a hazardous waste hauler, he replied he does not recall whom his transporter was. <br /> Per Mr. Proctor, he picks his transporter out from a phone book and he does not receive receipts when <br /> the hauler picks up used oil. Explained to Mr. Proctor that a registered licensed hazardous waste hauler <br /> must provide a receipt of pickup. <br /> -It is unlawful for any person to carry on, or engage in, the transportation of hazardous waste unless the <br /> person holds a valid registration issued by DTSC (Department of Toxic Substance Control). Hazardous <br /> waste transporter will accept waste for shipment for a generator with an EPA ID number. <br /> -Correct in the future by only contacting valid licensed registered hazardous waste hauler for removal of <br /> any hazardous waste. <br /> 301. Failed to maintain and minimize the release of hazardous waste. Around the used oil drums <br /> outdoor storage area, a 6 foot by 6 foot area of gravel and clay dirt is dark and appears to be from the <br /> spillage of used oil. The wooden pallet which the used oil drums are stored on is saturated with used oil. <br /> When Mr. Proctor was asked how he cleans up spilled oil, he stated a spill kit is located in the shop for <br /> spills inside. Per Mr. Proctor, the dirt is clay and the oil is not going anywhere and it's not his property. <br /> -Facilities shall be maintained and operated to minimize the possibility of fire, explosion, or any <br /> unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents to air, <br /> soil or surface water which could threaten human health or the environment. <br /> -By June 30, 2014, have all contaminated dirt, gravel and the saturated pallet properly disposed of by a <br /> California registered hazardous waste hauler under manifest and submit a photocopy of the manifest to <br /> the EHD. <br /> 404. Failed to keep containers closed except when adding or removing waste. At the used oil drum <br /> storage area, there are two drums of used oil and three drums of oily-water. The oily-water drums <br /> appear to be generated from rain-water since none of the three drums have caps for the openings. <br /> There were two open pans approximately 1 gallon each, stored behind the used oily-water drums, each <br /> full of dark green liquid which appears to be used antifreeze. Per Mr. Proctor, it could be used antifreeze <br /> but he did not walk to the pan to take a look. <br /> -All hazardous waste containers shall be closed at all times except when adding or removing waste. <br /> -Immediately close these containers and ensure all hazardous waste containers are closed when not <br /> adding or removing waste. <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE. <br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br /> EHD Inspector: Received By: Title: <br /> Thuy Tran (209) 468-8257 Sent by Certified Mail <br /> EHD 23-02-003 Rev 04/19/12 CONTINUATION FORM <br />
