Failed to properly label containers of hazardous waste. Two open pans of used antifreeze <br /> stored behind the used oil and oily-water drums are not labeled to identify the contents. Two 55 gallon <br /> drums full of used oil, three 55 gallon drums full of oily-water, and one poly tote approximately 250 <br /> gallons that appears to be less than 1/5 full of used oil had no labels to identify the contents. Per Mr. <br /> Proctor, he is pumping the used oil from the drums into the poly tote. Then the empty drums will be <br /> crushed for recycling. Per Mr. Proctor, his used oil haulers no longer take the containers instead they <br /> pump out the waste into their tanks. <br /> Explained the labeling requirements to Mr. Proctor. <br /> When asked the last time used oil had been picked up, he stated it has been years. He also stated that <br /> the drums of oily-water have been there longer than he has, pre-2006. He did not remember who the <br /> hauler was because he stated he randomly picks them out of the phone book. Explained to Mr. Proctor, <br /> hazardous waste must be picked up at minimum every six months. He stated he does not generate very <br /> much and the company does not have a large fleet. Explained to him that if he accumulates more than 2 <br /> drums of used oil, it must be hauled of approximately every 180 days. Requested he provide the <br /> property owner contact information since the oily-water drums have been here prior to his employment. <br /> Mr. Proctor stated he will not provide property owner information and because he is business owner, he <br /> has inherited the drums. <br /> -All hazardous waste containers shall be marked with the following information: <br /> 1. the words "Hazardous Waste", 2. name and address of generator <br /> 3. hazardous properties (toxic, corrosive, reactive or ignitable), 4.physical state (liquid or solid) <br /> 5. composition (contents), 6. accumulation start date <br /> Immediately label these containers and ensure that all containers are marked with all the required <br /> information. Since these containers have been on site longer than 180 days, immediately contact a <br /> licensed hazardous waste hauler to dispose of this waste under manifest and submit a copy of the <br /> manifest to the EHD. <br /> 407. Failed to mark empty container "Empty" and date it became empty. One blue 55 gallon metal drum <br /> was located nearby the used oil storage area. It was unclear if there was any product in the container as <br /> it was not marked with any label. When asked Mr. Proctor what the contents of the drum were, he stated <br /> it was empty and rocked the container to demonstrate it was empty. <br /> -Containers larger than five gallons that previously held a hazardous material shall be marked with the <br /> date they were emptied and managed within one year of being emptied. <br /> -Immediately mark and manage all empty containers per this section. <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE. <br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br /> EHD Inspector: Received By: Title: <br /> Thuy Tran (209) 468-8257 Sent by Certified Mail <br /> EHD 23-02-003 Rev 04/19/12 CONTINUATION FORM <br />
