People and Wal-Mart shalt be <br />4 referred to collectively as ·'Parties" and individually as "Party:' <br />5 INTRODUCTION <br />6 This matter relates to the People's investigation into Wal-Mart's compl iance with state laws <br />7 and regulati ons governing the s torage , handling, treatment. tran sportation, and disposal of <br />8 hazardous waste and hazardous materials pursuant to Health and SafelY Code Chapters 6.5. 6.7 , <br />9 and 6.95 a t Wal-Mart's operati ng retail facilitie s in Californ ia o n a nd before f-cbruary 22, 20 10. <br />10 As set forth in the Complaint filed concurrently herewith ([he "Complaint"), the People al lege <br />II that Wal·Mart v iolated Chapters 6.5 , 6.7, and 6.95 of Divis ion 20 of the Health and Safety Code <br />12 and the reguJalions promulgated under thes e chapters; and Business and Profe ssio ns Code section <br />13 17200, et seq., by its improper storage, handling, transportation, and disposal of haza rdous waste <br />14 and hamrd ous materials at and fr om Wal-Mart's California facilities from January 15 ,200 1, <br />15 through and including February 22 , 2010. <br />16 The Partics engaged in senlement ne gotiat ions prior to the filing of thi s Co nsent Judgment. <br />17 In these negot iations , the People were r epresented by the Attorney General o f the State of <br />18 Ca lifo rnia and the Di strict Attorneys for the co untie s of Los Angeles, Monterey, Orange, <br />19 Riverside , Sacramento, San Bernardino, San Diego, San Joaquin, and Solano, and the additional <br />20 Di stri c t Auomeys who are signatories to this Consent Jud gment Wal·Man was repre sen ted by <br />21 (Jibson, Dunn & Crutcher L LP. <br />22 The Peop le believe that the resolution embodied in this Consent Judgment is fair and <br />23 reasonable and ful fill s the People's enforcement objectives; that the tenns of the Consent <br />24 Judgment are appropriate; that no further action is warranted concerning the speci fi c vio lations <br />25 alleged in the Comp laint, except as provided in this Consent Judgment; and that entry of this <br />26 Consent Judgment is in the best interest of the public . <br />27 <br />28 <br />4 <br />STIPULATION FOR ENTRY OF FINAL J UDG MENT ON CONSENT
