INJUNCTIVE RELIEF <br />9 Pu rsuant to the provisions of Health and Safety Code sections 25181 , 25299.01. and 255 16, <br />10 and Business and Professions Code section 17203. but s ubj ect to Paragraph 24 below. \Val-Mart <br />II is pennanently enjoined to comply with Chapters 6.5, 6 .7 , and 6 .95 of Divi s ion 20 of the Health <br />12 and SafelY Code and the regulati o ns promulgated under the se chapters, at the Wal -Mart Facilities. <br />13 Failure to comply with this injunction and the specific additional injunctive prov isions that foll ow <br />14 may s ubject Wal-Mart to sa nctions, including, but nOllimited t o, contempt and additional <br />15 penalties. Paragraph 15 below applies to any application or motion for failure to comply with the <br />16 injunctive provisions of this Consent Judgmenl. <br />17 5.1 Specific Injunctive Provisions: <br />18 5.I.a. Wal-Mart s hall not dispose, or cause the disposa l o f , hazardous wastc to drains, <br />19 sinks, or toilets at a Wal·Mart Facility, o nto the surface or s ubsurface of the ground at any <br />20 unauthorized location, at a landfill o r transfer station not authorized to receive hazardous waste, <br />21 or at any othe r unauthorized point in v i o lation of Chapter 6.5 of D ivision 20 of the Health and <br />22 Safety Code. <br />23 S.I.b . Wal -Mart shall detcnnine. at each Wal -Mart Faci li ty, whether each itcm returned by <br />24 a customcr to that facility is a waste and if so, is a "hazardous waste" as required by California <br />25 Code of Re gulation s, tit le 22, section 66262.11. <br />26 S.I .c. Wal-Mal1 sha ll also determine, at each Wal-Mart Facility, whether each waste <br />27 g enerated at that facility as a result of spi ll s, container breakage or other mean s, is a "hazardous <br />28 waste" as required by Ca lifo rnia Code of Regulations, titl e 22, section 66262.11. <br />7 <br />STIPULAT ION FOR ENTRY OF FINAL JUDGMENT ON CONSENT
