Wal-Mart shall handle any ha7.ardous waste identified pursuant to paragraphs S.I .b . <br />a nd S.l.e in accordance w ith the requirements ofChaplcr 6.5 of the Health and Safety Code and <br />it s implementing regulations in the California Code of Regulations, title 22. <br />S.l.c. Wal-Mart s hall not transport hazardous waste on its own truck neet unle ss it holds a <br />valid reg istrat ion t o do so, as requ ir ed by Hea lth and Safety Code secti on 25163. Wal-Mart shal l <br />also I10t transfer custody ora hazardous waste to a tran sporter who does not hold val id <br />regis tration under Health and Safet y Code sect ion 25163. <br />5 .1.1'. Wal -M art sha ll not transport items that would be considered ha zardo us in Cal ifornia <br />pursuant to cha pter II of Title 22. Di v isio n 4.5 of the California Code of Regulations , in th e State <br />of Ca liforni a as part of its "reverse logistics" process to centralize the management of returned <br />items at Wal-Mart Return Centers. unless Wa l-Mart has a contractual agreement or ge nera l <br />practice I providing for the return of the item to the manufacturer, or the item may be donated, <br />resold. reused , or recycled in a manner that docs not constitute discard pursuant to California <br />Code of Regulations, Title 22, sect ion 66261.2. <br />5.l.g. Wal -Mart sha ll properly and timely dispose of accumulated hazardous waste at each <br />Wal-Mart Facility at least once every ninety (90) days, and shall timel y cause to be filed its <br />hazardous waste manifests with the Department of Toxic Substances Control ("D1'SC"), as <br />provided by Health & Safety Code sec ti on 2S 160(b)(3) and California Code of Regulations, Title <br />22. sect ion 66262.23, o r timely notify the DTSC o f th e treatment, sto rage , o r disposal facility's <br />failure to return an executed manifest. <br />5.l.h. Wal-Mart s hall conduct weekly inspecti ons of hazardous waste storage areas at each <br />Wal-Mart Faci lity, as required by California Code of Regulations, Title 22 , sections 66262.34 and <br />66265.174. <br />5.I.i. Wal-Mart shall treat discarded o r n o lo nge r usable non-empty aeroso l cans either: (i) <br />as universal waste as required by Cal ifornia Code of Regu la tions, Title 22, C hapter 23, section <br />I "General practice" refe rs to those c ircumstances w here there is n o contractual agreement <br />between a ven d or and Wal-Mart regarding disposition ofa returned item, or where a vendor with <br />s uch a contractual agreement with Wal-Mart changes the dispos ition of an item without formally <br />changing the entire agreement. <br />8 <br />STIPULATION FOR ENTRY OF FINAL J UDGMENT ON CONSENT
