Wal-Mart sh all comply with employee training obligations as required by Californi a <br />Code or Regulations. Title 22, section 66265.16. pertaining to handling of haza rdo u s waste, <br />includin g, but not limited 10, the req uirement to maintain for a period of three years trainin g <br />documentation for each employee involved in hazard ous waste handling at each Wal-Mart <br />Facil ity. The employee training shall include a description of the requirements set forth in th e <br />injunctive provisions of this Consent Judgment. <br />5.I.k. Wal-Mart shall have in place at all times a hazardous waste contingency plan and <br />emergency procedures for each Wal-Mart Faci l ity, as required by Cal ifornia Code of Regu lations , <br />T itl e 22, secti ons 66265.51 rhrough 66265.56. <br />5.1.1. Wal-Mart shall, at e ach Wal-Mart Facility, implement. maintain, and submit to the <br />administering agency (as defined in Health and Safety Code sec ti ons 25501 and 25502), a <br />comp lete hazard ous materials business plan, as required by Health and Safety Code sections <br />25504 and 25505 and California Code of Regulations, Title 19 , section 2729. Such hazardous <br />material s bus iness plan s hall include procedures for e m ergen cy response to a release or threatened <br />re lease ofha7.ardolls materials as required by Health and Safety Code secti on 25503.5. Such plan <br />sha ll also include an employee trainin g program that meets the requirements of Ileahh and Safety <br />Code section 25504(a) and (c), and California Code of Regulations, Titl e 19, secti on 2732. <br />5.I.m. Wal-Mart shall operate its existing tanks in va ul ts in accordance with thc <br />requirements of Chapter 6.7 o f the Health and Safety Code, unles s exempt under Health and <br />Safety Code section 25283.5 in accordance with the following c riteria: (I) all exterior surfaces of <br />the tank , including connected pip ing. and the floor directly beneath the tank, can be monitored by <br />direc t viewing, (2) the tank has secondary containment or the structure in which the tank is <br />located is constructed in s uch a manner that the structure provides for secondary containment of <br />th e contents of the tank, as determined by the local agency designated pursuant to Section 25 283, <br />(3) the owner or operator conducts weekly in specti ons of the tank and ma in tains a log of the <br />in spect ion re sults for review by the local agency designated pursuant to Section 25283, as <br />9 <br />STIPULATION FOR ENTRY OF FINAL JUDGM ENT ON CONSENT
