This framework, contained in Hazardous Waste Contfol Law, Chapter 6.5 of <br />Division 20 of the Health and Safety Code, section 2S I 00 et seq. ("1-1 We L " or "Chapter 6.5") and <br />its implementing regulations , which arc found at California Code of Regulations, tit le 22, section <br />66260.1 cl seq., mandates a "cradle to grave" system. The HWCL sys tem is maintained to record <br />the regi stration, tracking, storage, treatment, and di s posal of hazardous wastes and to prov ide for <br />the protection of the public from th e potcmia[ risks posed hy hazardou s wastes. <br />14. The HWCL is the California ana log or the federal Resource Conservation and <br />Recovery Act, 42 U.S.C. secti on 690 1 ct seq. ("RCRA"). Purs uant to stale and federal law, the <br />California Department of T oxic Substan ces Control ("'DTSC') administers the H WCL in lieu of <br />fed e ral administrat.ion ofRCRA in Californ ia. (Sec H ea hh & Saf. Code, § 25101, s uhd . (d).) <br />Federal law prohibit s California from imposing "any requirements less stringent than those <br />authorized un der [RCRAj." (42 U.S .C. § 6929.) <br />15. The H WCL has in certain instances a more in clusive definition of hazardous waste <br />tha n does fede ral la w. Hazardous wastes [hat are regulated under California law but not federal <br />law are known as "non-RCRA hazardous wastes." (H ealth & Saf. Code, § 25 117.9.) <br />16. Companies th at accum ul ate or ge nerate hazardous waste in the co ur se of the ir <br />operations and send {hat waste o fTsi te for management are subject to certain regulato ry <br />requirements. (See Ca l. Code Re gs., tit. 22, § 66262 .10 et seq.) <br />17. It is unlawful for any person to tran sport ha:r..a rdous wastes unle ss the person h o lds <br />a valid registration iss ued by the DTSC, and it is unlawful for any person to transfer custody of a <br />hazardous waste to a transporter who does not ho ld a va li d registration. (Health & Saf. Code, § <br />25163, subd. (a).) <br />18. Chapter 6.7 of Division 20 of the Health and Safety Code regulates the <br />underground s torage of hazardous s ub stance s in the State of Ca li fornia. It estab li shes <br />requirements to "ensure that newly constructed un de rgro und storage tanks meet appropriate <br />standards and that existing tanks be properly maintained, inspected, tested, and upgraded so that <br />the health , property, a nd resources of the people of the state w ill be protected."
