Secti o n 251 89 o f th e H ealth and SafelY Code c reate s liability for an y ne g li gen t or <br />intentional v iolat io n of th e H \Vel.. or for an y v io lat io n of an y perm it , rule , regulation. st an dard , <br />or requirement issued o r promul gated pursuant to the II WCL. Section 25189 .2 is an a lt ernative <br />stri c t li abil it y provi s ion , which creates li ab ilit y for any vio lati o n of the I-IWCL , or for an y <br />violation o f an y permit, fule , regulation , standard, or requirement issued o r promulgated pursuant <br />10 Ihe HW CL. <br />21 . The HW C L, pursuant to Health and Safety Code section s 2518 [ and 25184, <br />authorizes the Court to iss u e an order that enjoins a n y o ngoing or potential vi o lati on or the <br />I-I W C L , or any a p p l icable rule , regu la tion, p e rmit , standard, re quire ment, or o rder iss ued o r <br />pro mul gated pursuant to th e HWCL. <br />22. Sect io n 2518 1 o f t he H eal th and Safely Code pro v id es that when th e DTSC or a <br />u n ified program age ncy det ennines that a ny person ha s e n gaged in , is engaged in, o r is a bout to <br />e n gage in any act s or practi c e s which constitute o r wi ll constilU te a vio lation o f any pro v is io n of <br />the H \VeL or any rule rcgulat io n , o r requireme nt iss ued o r pro mu lgated the reund er, and when <br />requ ested by the DTSC o r unified program agc n cy, the Attorney General or local prosecuto r may <br />m ake an application to the superior court for a n o rder enjoining such acts or practi ces. o r for an <br />order directin g compl ian ce, and upo n an appropri ate showing by th e DTSC o r uni fied p rogram <br />agen cy th a t s uc h person h as enga ged in o r is about to en gage in any such acts o r practices, a <br />p ermanent or te m porary injunctio n , re straining o rder, o r o ther o rd e r may be g ranted. <br />23 .
