Waste acetone and waste paint stripper(Jem Strip 427) are being recycled onsite and all the required information to claim the exclusion or exemption has not been submitted, according to reviewed records in December of 2016, this facility recycled 208 gallons of acetone. To claim an exclusion or exemption from classifying this as a waste, the following information shall be submitted every two years: - name„ site address, mailing address, and telephone number of the owner or operator of the facility that recycles the material; - name and address of the generator of the recyclable material; -documentation that the requirements of any exemptions or exclusions pursuant to HSC 25143.2 are met. Submit statements or documentation showing that above materials meet the recycling exemption of HSC 25143.2 and which subsection applies. Immediately provide all required information for every recyclable material that you wish to claim the exclusion or exemption and provide that information every two years. Also, submit the Recyclable Materials Report in CERS, and maintain recycling records onsite for review during inspection. If the required information cannot be provided, the materials must immediately be handled as a hazardous waste. This is a Class II violation. 117 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. An inspection was last done on 6-16-2014 and an inspection report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted 30 days from the receipt of the full inspection report. This information has not been received in its entirety resulting in a non-compliant status for this facility. An operator that receives an inspection report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken, refer to the 6-16-2014 inspection and the follow up correspondence for the outstanding violations. Ensure that a written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. This is a Class II violation.
