The generator shall retain on site for at least three years a legible copy of each manifest or bill of lading which identifies spent lead acid batteries shipped to a person who stores, uses, reuses, recycles, or reclaims the batteries or their components. Immediately locate a copy of all disposal records for spent lead acid batteries for the last three years, maintain them on site, and submit copies to the EHD by April 29, 2012. 128. Bills of lading for the recycling of used oil filters for 2010 and 2011 were not found on site. A copy of each bill of lading must be kept on site for at least three years. At the time of inspection, it could not be demonstrated (not necessarily documented) that employees who handle hazardous waste were properly trained. According to Mr. Mansfield, no training has been conducted. The generator must ensure that all employees who handle hazardous waste are thoroughly familiar with proper waste handling and emergency procedures. Immediately provide training to all employees who handle hazardous waste and submit a copy of the training records to the EHD by April 29, 2012. Complete and submit a copy of the Return to Compliance Certification to the EHD by April 29, 2012 along with a statement documenting the corrective actions that have been or will be taken for each violation and any supporting paperwork. Notes: (corrected on site) - Oily rags were observed in the trash and are being disposed of without first determining hazardous properties. Any person who generates a waste shall determine if the waste is a hazardous waste. The rags were removed from the trash, placed in a drum on site, and labeled as hazardous waste at the time of inspection. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
