inspection Report '. ! Facility Name <br /> Pilkington North America, Inc. <br /> VII. Additional violations <br /> Class I Violations. <br /> 1. On or about December 14, 2010, PNA violated Health and Safety Code section 25201(a) <br /> and Cal. Code Reg., tit.22 section 66262.34(a), in that PNA engaged in the storage of <br /> hazardous waste for more than 90 days without a permit or grant of authorization. This Class <br /> violation was observed at the following locations: <br /> a. "Warehouse called as butler building": <br /> DTSC staff observed one 55-gallon drum containing glass primer dated 06/20109. <br /> b. "Hazardous waste storage building": <br /> DTSC staff observed one 55-gallon drum of empty paint cans dated 8125110. <br /> Corrective Action: Within 30 days of receipt of this inspection report, PNA must appropriately <br /> ship off the hazardous waste situated in the hazardous waste storage area and provide a copy <br /> of the manifest to DTSC. <br /> 2. On or about December 14, 2010, PNA violated Cal. Code Reg., tit.22 section 66265.31, in <br /> that the facility failed to maintain or operate to minimize the possibility of release to the <br /> environment. This Class I violation was observed at the following locations: <br /> a. "Raw material section": <br /> DTSC staff observed selenium and cobalt powder on the floor near the selenium and cobalt feed tanks in the raw material section.The MSDS <br /> shows that floor sweep containing selenium is an extremely hazardous waste. <br /> b. "Wastewater treatment plant area": <br /> DTSC staff observed oily spills on the floor from the leaking pump <br /> c. "Maintenance shop": <br /> DTSC staff observed oily spills on the floor from the leaking hose near the oil storage tank <br /> Corrective Action: Within 30 days of receipt of this inspection report, PNA shall clean above <br /> mentioned areas and submit photographic evidence to DTSC. PNA shall also submit to DTSC <br /> a plan to prevent reoccurrence that describes in detail the corrective actions taken to prevent <br /> reoccurrence of this violation in future. <br /> 3. On December 14, 2010, PNA violated California Health & Safety code section 25186.5, in <br /> that the facility disposed "spent Selenium floor sweep" to the trash in the raw material section. <br /> The MSDS shows that floor sweep containing Selenium is an extremely hazardous waste. in <br /> addition, PNA also disposed off "empty containers of glass primers and paints in the trash can <br /> in the storage building called as butler building. <br /> Corrective Action: Within 30 days of receipt of this inspection report, PNA shall submit <br /> evidence that the facility is managing the hazardous waste correctly. PNA shall also submit to <br /> DTSC a plan to prevent reoccurrence that describes in detail the corrective actions taken to <br /> prevent reoccurrence of this violation in future. <br /> 4. On or about December 14, 2010, PNA violated Cal. Code Reg., tit.22 sections 66262.11, in <br /> that he facility fail to make correct waste determination for the spent Selenium floor sweep <br /> 70 of 73 <br />
