Any person who generates a waste shall determine if the waste is a hazardous waste. <br /> Immediately stop sending filter ash back, make a hazardous waste determination for the filter ash, and manage it <br /> according the Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining <br /> how this waste was managed. <br /> This is a repeat violation, Class Il. <br /> 501 CCR 66265.192(a) Failed to comply with new hazardous waste tank system assessment requirements. <br /> Facility does not have a tank assessment for the 500 gallon used oil tank. The most recent tank assessment was <br /> dated June 12, 2010. The owner or operator of a hazardous waste tank shall obtain a written assessment reviewed <br /> and certified by an independent, qualified, professional engineer, registered in California attesting that the system has <br /> sufficient structural integrity, is acceptable for the transferring, storing, and treating of hazardous waste, and that the <br /> tanks and containment system are suitably designed. Immediately have an assessment prepared for the used oil <br /> tank.
