Manifest numbers 010197567JJK and 010197566JJK were found without a signed off copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. By [DATE,30 DAYS FROM NOWJ, submit to the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. This is a minor violation. 501 CCR 66265.192(a) Failed to comply with new hazardous waste tank system assessment requirements. Facility does not have a tank assessment for the 1000-gallon used oil tank. The owner or operator of a hazardous waste tank shall obtain a written assessment reviewed and certified by an independent, qualified, professional engineer, registered in California attesting that the system has sufficient structural integrity, is acceptable for the transferring, storing, and treating of hazardous waste, and that the tanks and containment system are suitably designed. Immediately have an assessment prepared for the 1000-gallon used oil tank. Submit a schedule showing when this will be accomplished to the EHD. This is a minor violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by November 15, 2014. Consent to perform the inspection, take photos and collect samples was given by Rajinder Singh the business owner. Facility generated 20.8175 tons of hazardous waste from the truck repair operation in 2013. Rajinder has operated the same facility since 2011, but the business has become incorporated in August 2014. A Checklist Only was left on site on October 14, 2014, and the report generated on October 15, 2014 has since been revised: Violation #106 was removed since generator was able to complete the Contingency Plan, assigned emergency coordinator and alternative, and submitted document to CERS on site during this inspection. This Official Inspection Report supersedes all previous reports.
