The profile(profile#1275057)from clean harbors for the pit sludge says on the first page it is non-hazardous. On the last page it says the waste is Non-RCRA hazardous waste. Four 55 gallon drums of the pit sludge was seen at the time of inspection. The drums were labelled with a hazardous waste label as well as"pit sludge non haz". When Douglas was asked if the waste was considered hazardous on non hazardous he could not provide an answer. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately , make a hazardous waste determination for the pit sludge , and manage it according the Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was managed. This is a Class II violation. Page 3 of 6
