Hazardous waste generators shall retain copies of all manifests signed off by the destination <br /> facility on site for three years and have them readily available for review. If the generator did not receive a copy of the <br /> manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was <br /> submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the <br /> transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator <br /> did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by <br /> the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing <br /> manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the <br /> results of those efforts. Exception reports shall be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to <br /> the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. <br /> This is a Class II violation. <br /> 301 CCR 66265.31 Facility not maintained to minimize the release of a hazardous waste. <br /> The following was noted at the time of inspection: <br /> 1) One leaking fork lift(with some absorbent below it)was noted outside, in the vicinity of the diesel fuel tank(located <br /> on the southwest portion of the property). <br /> 2) Several pieces of I leaking machinery (which was being repaired) were also noted inside the shop area. <br /> 3)Oily ground with some applied absorbent was noted near the waste oil tank, located inside the indoor hazardous <br /> waste storage area. <br /> Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous <br /> waste to air, soil, or surface water which could threaten human health or the environment. Immediately fix all leaks <br /> and clean all the staining and manage all clean up debris according to Title 22 hazardous waste regulations. Submit a <br /> statement and supporting documentation explaining how this waste was managed. <br /> This is a Class II violation. <br /> 302 CCR 66265.32 Failed to maintain required emergency equipment. <br /> An eye wash station located inside the hazardous waste storage area had an expired eye wash solution,which <br /> expired on 3/2011. All facilities shall be equipped with an internal communication or alarm system, a device capable of <br /> calling outside emergency help, spill control equipment, and decontamination equipment at all times. Immediately <br /> provide all necessary decontamination equipment and maintain it on site. Submit proof of correction to the EHD. <br /> This is a Class II violation. <br /> Page 8 of 12 <br />
