—>Current owner information was not updated and resulted in the need for site visits. <br /> Health & Safety Code (HCS) 25292.2(a) All owners and operators of an underground tank <br /> system shall maintain evidence of financial responsibility for taking corrective action and for <br /> compensating third parties for bodily injury and property damage caused by a release from the <br /> underground tank system, in accordance with regulations adopted by the board pursuant to <br /> Section 25299.3. The regulations shall include a schedule that requires that financial <br /> responsibility requirements are phased-in for all underground storage tank systems on or before <br /> October 26, 1990. <br /> —>This facility did not have Certification of Financial Responsibility at the time of inspections <br /> on 6/23/04& 7/07/04. <br /> HSC 25299(a)(9) Disabling leak detection devices. Any operator of an underground tank <br /> system shall be liable for a civil penalty or not less than five hundred dollars ($500) or more than <br /> five thousand dollars ($5,000) for each underground storage tank for each day of tampering with <br /> otherwise disabling automatic leak detection devices or alarms. <br /> This facility had a raised sensor in one of it's dispenser pans. It last alarmed on April 7, <br /> 2004. This would indicate that the alarm had been disabled for 77 days. The violation was <br /> corrected during the unannounced inspection on June 23, 2004. <br /> CCR 2635 (b)(1) The spill container shall collect any hazardous substances spilled during <br /> product delivery operations to prevent the hazardous substance from entering the subsurface <br /> environment. <br /> —>This facility had a diesel spill bucket that did not pass the annual spill bucket test on 7/7/04. <br /> No corrective documentation has been received as of 9/27/04. <br /> CCR 2712(i) A copy of the permit and all conditions and attachments, including monitoring <br /> plans, shall be retained at the facility. <br /> —>A monitoring and response plan was not found at the facility during inspections conducted <br /> on 6/23/04 & 7/07/04. <br /> CCR 2712(b) Written monitoring and maintenance records shall be maintained on-site for a <br /> period of at least 3 years. <br /> -> This facility has failed to provide maintenance records. As of 9/27/04 this facility has <br /> not provided these documents. <br /> Hazardous Waste Violations <br /> CCR 66262.12(a) Except as specified in (d), a generator shall not treat, store, dispose or <br /> transport or offer for transportation, hazardous waste without having received an Identification <br /> Number. <br /> —>This facility does not have an EPA ID number. <br /> CCR 66262.40 (a)/HSC 25160.2(b)(3) A generator shall keep a copy of each manifest signed in <br /> accordance with section 66262.23(a) for three years or until the generator receives a signed copy <br /> from the designated facility which received the waste. This signed copy shall be retained as a <br /> record for at least three years from the date the waste was accepted by the initial transporter. <br /> —>This facility has not provided disposal documentation for any of it's spent absorbent or fuel <br /> filters. <br /> 3 <br />
