--It is also possible that hazardous waste could be discovered during
demolition of existing features or construction activities.
The present condition of the property is at least a nuisance requiring
cleanup by the owner if a complaint is filed and could require a more
detailed investigation if directed by San Joaquin County Local Health
District. The underground tanks are not in compliance with abandonment
requirements and extensive testing and/or equipment could be necessary
to bring them into compliance.
Tank replacement up to current requirements should not be required of
Caltrans even if it is necessary to acquire the tanks portion of the
property. Caltrans should be able to recover costs for any
contamination clean-up expenses. Caltrans could also negotiate R/W
acquistion based on owner removal of all tanks etc. The new buyer
appears to have hired an underground tank consultant and may have
additional information on the status of underground tank integrity.
t'
Dale Steele
Hazardous Waste Coordinator
attachments
State of California "
Department of Transportation
District 10
1976 East Charter Way
P.O.
