5. Failed precision test and failure to file Unauthorized Release Report within 5 days - Section 25295 6. Operation of UGST's without PHS-EHD permit - Section 25284 7. Abandoned underground storage tanks - Section 25298 V. STATEMENT OF FACTS: 4-7-88 Tom Franken of North Cal Construction notified PHS-EHD that a precision test failed on the 10, 000 gallon unleaded UGST #2 . 4-8-88 Field inspection performed by Dan Moe, R.E.H. S. Operator Mike Cupka was instructed to submit all precision test results to this office. It was also noted that Mr. Cupka was not keeping proper records (no quarterly reports or inventory reconciliation records) at the time of inspection as required by Title 23 , CCR, Section 25293 . (See Exhibit A) 4-12-88 Received precision test results for all three tanks from North Cal Construction. (See Exhibit B) Received letter from North Cal Construction. (See Exhibit C) 4-20-88 Mickey James, American Savings representative, agreed to get responsible party to submit in writing a determination if the 10, 000 gallon unleaded tank or pipelines had leaked. 4-22-88 Mike Cupka, operator, was issued a "Notice to Abate" . (See Exhibit D) Operator was instructed to: a. file an Unauthorized Release Report within 5 days of knowledge of failed precision test. b. Verify if tank and/or pipelines are leaking. C. Take tank out of service and empty tank if warranted. d. Submit plans for tank repair or removal. 4-25-88 A letter was received from Tom Franken, Nor Cal Construction, stating he was 65% certain that the 10, 000 gallon unleaded tank was leaking rather than the pipelines. The tank was still in service and in violation of abatement order issued by Dan Moe, R.E.H.S. , on 4-22-88. Office hearing was requested at this time by Dan Moe, R.E.H.S. (See Exhibit E)
