5. Failed precision test and failure to file Unauthorized <br /> Release Report within 5 days - Section 25295 <br /> 6. Operation of UGST's without PHS-EHD permit - Section 25284 <br /> 7. Abandoned underground storage tanks - Section 25298 <br /> V. STATEMENT OF FACTS: <br /> 4-7-88 Tom Franken of North Cal Construction notified PHS-EHD <br /> that a precision test failed on the 10, 000 gallon <br /> unleaded UGST #2 . <br /> 4-8-88 Field inspection performed by Dan Moe, R.E.H. S. <br /> Operator Mike Cupka was instructed to submit all <br /> precision test results to this office. <br /> It was also noted that Mr. Cupka was not keeping proper <br /> records (no quarterly reports or inventory <br /> reconciliation records) at the time of inspection as <br /> required by Title 23 , CCR, Section 25293 . (See Exhibit <br /> A) <br /> 4-12-88 Received precision test results for all three tanks <br /> from North Cal Construction. (See Exhibit B) <br /> Received letter from North Cal Construction. (See <br /> Exhibit C) <br /> 4-20-88 Mickey James, American Savings representative, agreed <br /> to get responsible party to submit in writing a <br /> determination if the 10, 000 gallon unleaded tank or <br /> pipelines had leaked. <br /> 4-22-88 Mike Cupka, operator, was issued a "Notice to Abate" . <br /> (See Exhibit D) <br /> Operator was instructed to: <br /> a. file an Unauthorized Release Report within 5 days <br /> of knowledge of failed precision test. <br /> b. Verify if tank and/or pipelines are leaking. <br /> C. Take tank out of service and empty tank if <br /> warranted. <br /> d. Submit plans for tank repair or removal. <br /> 4-25-88 A letter was received from Tom Franken, Nor Cal <br /> Construction, stating he was 65% certain that the <br /> 10, 000 gallon unleaded tank was leaking rather than the <br /> pipelines. The tank was still in service and in <br /> violation of abatement order issued by Dan Moe, <br /> R.E.H.S. , on 4-22-88. Office hearing was requested at <br /> this time by Dan Moe, R.E.H.S. (See Exhibit E) <br />
