4-29-88 Administrative Office Hearing was scheduled for 3 : 00 pm on 5-13-88. Notice of pending hearing sent to Smith- Barton Properties with a carbon copy to American Real Estate. (See Exhibit F) 5-13-88 No one appeared for the scheduled Administrative Office Hearing. 5-24-88 Major Stations, Inc. submitted bankruptcy papers to this office. (See Exhibit G) 5-25-88 Jeanne Zolezzi, attorney for Mrs. Conrady, contacted PHS-EHD stating that her client may not be interested in foreclosing on the property now owned by Smith- Burton Properties. This property was now in bankruptcy, with the hearing scheduled for June 2 , 1988, in Modesto, CA. Ms. Zolezzi indicated that her client may perform a subsurface investigation to determine if contamination has occurred. Public Record Release Request filed. (See Exhibit H) 6-21-88 Lisa Brown, Deputy DA, notified of status of facility. She requested a referral be sent her office. 10-11-88 Stockton Service Station Equipment Company, Inc. uncovered top of the 10, 000 gallon unleaded tank, and no visual evidence of soil contamination was noted by Kasey Foley, E.H.S. , in this location. (See Exhibit I) 1-11-89 PHS-EHD was informed that the precision test on the 10, 000 gallon unleaded tank, performed by Stockton Service Station Equipment Company, Inc. , on 12-2-88 , had failed. 1-23-89 Doug Bitner of American Savings and Loan (New West Federal) claimed to hold the 2nd deed on the property and was aware of the failed precision test. He stated that they had closed down the station. Letitia Resch, E.H.S. requested precision test results and a status on the tanks (i.e. empty/full) . 1-24-89 PHS-EHD was contacted by Mr. Herb Young, attorney for the bankruptcy of Major Stations, Inc. He was advised to provide the current status of the tanks and was mailed tank closure and site assessment information. 2-21-89 Richard Zipp of Thorne Environmental requested and was mailed site assessment information. 3-1-89 Kasey Foley, E.H. S. , contacted Chuck Pomery, attorney for American Savings, and again requested the results of the 10, 000 gallon unleaded tank precision test performed 12-2-88.
