Pomery: <br /> I conveyed to the local Health Department your desire to have the <br /> state perform the clean up of the above referenced site and then <br /> lien the property or bill responsible parties . I was informed <br /> that no mechanisms exist for such action. The Regional Water <br /> Quality Control Board has delegated enforcement of underground <br /> tank program to the County and it is up to the County to gain <br /> compliance. <br /> The local Health Department also pointed out to me that site <br /> clean up is a separate issue from the most pressing problem which <br /> is proper or closure/abandoment of the tank . It would appear we <br /> have no alternative offer than filing a civil suit for civil <br /> penalties and injunction against your client, American Savings. <br /> I will delay filing until January 19, 1990, to give you time to <br /> submit a closure plan to the Health Department .
