FOLEY <br /> Sanitarian <br /> Re: MAJOR MART GAS STATION <br /> 1235 East Alpine Road <br /> Stockton, California <br /> Dear Ms. Foley: <br /> This letter is to bring you up to date as to American Savings <br /> Bank' s activities in connection with the property. <br /> By way of background, I need to point out to you that American <br /> Savings Bank arises out of a reorganization of a previously <br /> bankrupted American Savings and Loan. The present bank is <br /> basically operating under the jurisdiction of FSLIC of the <br /> Federal Government in connection with its reorganization. <br /> We are presently seeking authority to file an action to rescind <br /> the acquisition by foreclosure of the Major Mart property. At <br /> the time American foreclosed on the property, it had no knowledge <br /> of the contamination on the site which was left there by the <br /> prior owners and operators. Our problem in connecting any <br /> activities on the site is that we first need FSLIC approval. <br /> Secondly, the prior owner and operator for many years, Marjorie <br /> Conrady, holds a First Deed to Trust on the property in an amount <br /> which equals or exceeds the equity in the property. Since <br /> American Savings is under reorganization and Federal supervision, <br /> it is difficult to obtained permission to proceed to spend money <br /> of a bankrupt organization on property where there is no equity. <br /> We have been attempting to negotiate some workable arrangement <br /> with Marjorie Conrady and her attorney, Jeanne M. 2olezzi of the <br /> firm of Neumiller & Beardslee located at Fifth Floor Waterfront <br /> Office Tower II, 509 West Weber Avenue, Stockton, California <br />
