4 No manifests were found on site at the time of the August 19, 2004 routine <br /> hazardous waste inspection. Facility was asked to submit copies of all manifests to <br /> this office within 30 days, but were never received. <br /> HSC 25185 (c)(3) Certification of return to compliance. The operator of the site or <br /> facility which receives an inspection report pursuant to paragraph (2) shall submit a <br /> written response to the department or the local officer or agency authorized to enforce <br /> this chapter pursuant to subdivision (a) of Section 25180 within 60 days of receipt of the <br /> inspection report, or within a shorter time as the department or the local officer or agency <br /> may reasonably require, which shall include a statement documenting corrective actions <br /> taken by the operator or proposing corrective actions which will be taken by the operator, <br /> for purposes of compliance with this chapter, or disputing the existence of the violation. <br /> --) A written response that includes a corrective actions statement regarding the <br /> August 19, 2004 routine hazardous waste inspection has not been submitted to this <br /> office. <br /> Title 22, CCR 66262.12 (a) Managed a hazardous waste without an EPA number. <br /> Except as specified in (d), a generator shall not treat, store, dispose of, transport or offer <br /> for transportation,hazardous waste without having received an Identification Number. <br /> 4 This facility does not have a valid EPA ID number to manage hazardous waste. <br /> Title 22, CCR 66262.34 (f) Failed to properly label containers of hazardous waste. <br /> Generators who accumulate hazardous waste on site without a permit or grant of interim <br /> status shall comply with the following requirements: <br /> (1) the date upon which each period of accumulation begins shall be clearly marked and <br /> visible for inspection on each container and portable tank; <br /> (2) the date the applicable accumulation period specified in subsection (a) or (d) of this <br /> section begins, for purposes of subsections (a) and (b) of this section, shall be clearly <br /> marked and visible for inspection on each container and tank; and <br /> (3) each container and tank used for onsite accumulation of hazardous waste shall be <br /> labeled or marked clearly with the words, "Hazardous Waste." Additionally, all <br /> containers and portable tanks shall be labeled with the following information: <br /> (A) composition and physical state of the wastes; <br /> (B) statement or statements which call attention to the particular hazardous properties <br /> of the waste(e.g., flammable, reactive, etc.); <br /> (C)name and address of the person producing the waste. <br /> 4 A hazardous waste container of used absorbent was found not properly labeled <br /> at the time of the August 19, 2004 and July 13, 2005 routine hazardous waste <br /> inspections. A return to compliance statement was not submitted to this office for <br /> either violation. <br /> Title 22, CCR 66262.40 (a) Failed to keep signed copy for three years. A generator <br /> shall keep a copy of each manifest signed in accordance with section 66262.23(a) for <br /> three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three <br /> years from the date the waste was accepted by the initial transporter. <br /> 6 <br />
