4 No manifests were found on site at the time of the August 19, 2004 and July 13, <br /> 2005 routine hazardous waste inspections. Facility was asked to submit copies of all <br /> manifests to this office within 30 days on the 2004 inspection report, but were never <br /> received. A return to compliance statement was not submitted to this office for <br /> either violation. <br /> Underground storage tank violations <br /> HSC 25284 (a) (1) Permit to operate. Except as provided in subdivision (c), no person <br /> may own or operate an underground storage tank unless a permit for its operation has <br /> been issued by the local agency to the owner or operator of the tank, or a unified program <br /> facility permit has been issued by the local agency to the owner or operator of the unified <br /> program facility on which the tank is located. <br /> --> Facility operated a UST system without a valid operating permit after facility <br /> was placed out of compliance on August 24, 2004. <br /> HSC 25291 (a)(2) Secondary containment for UST is tight. Secondary containment <br /> shall be constructed to prevent structural weakening as a result of contact with any <br /> released hazardous substances, and also shall be capable of storing the hazardous <br /> substances for the maximum anticipated period of time necessary for the recovery of any <br /> released hazardous substance. <br /> 4 The turbine sumps failed secondary containment testing on March 23, 2003 and <br /> the facility was sold to Mr. Rizwan in this condition in January 2004. The sumps <br /> were repaired sometime between August 19, 2004 and March 27, 2006, but failed to <br /> do so under permit and inspection of this office. <br /> HSC 25299 (a)(9) Disabling leak detection devices. Tampering with or otherwise <br /> disabling automatic leak detection devices or alarms. <br /> 4 Sensors were found raised 4-5 inches above the lowest point of the turbine sumps <br /> at the time of the August 19, 2004 routine UST inspection. These were relocated to <br /> the lowest point in the sump by the service technician after testing was completed. <br /> HSC 25292.2 Certification of financial responsibility and CFO letter. All owners <br /> and operators of an underground tank system shall maintain evidence of financial <br /> responsibility for taking corrective action and for compensating third parties for bodily <br /> injury and property damage caused by a release from the underground tank system, in <br /> accordance with regulations adopted by the board pursuant to Section 25299.3. The <br /> regulations shall include a schedule that requires that financial responsibility <br /> requirements are phased-in for all underground storage tank systems on or before October <br /> 26, 1990. <br /> 4 Current copies of the financial responsibility documents were not on Me with this <br /> office at the time of the June 11, 2004 routine UST inspection. Current copies were <br /> submitted on July 20,2004. <br /> 7 <br />
