1 <br /> 2 IT IS ORDERED, ADJUDGED AND DECREED as follows: <br /> 3 1. This court has jurisdiction of the subject matter of this action and each of the parties <br /> 4 hereto. <br /> 5 2. The injunctive provisions of this Final Judgment are applicable to SHELL I-5, hereinafter <br /> 6 referred to as Defendant,their subsidiaries and divisions, and any agent, employee,representative and <br /> 7 all persons, corporations, or other entities acting by,through, under, or on behalf of Defendant and all <br /> 8 persons in concert with or participating with said Defendant with actual or constructive knowledge of <br /> 9 this injunction, only insofar as they are doing business in the State of California and confined to <br /> 10 Defendant's GASOLINE STATION activities, located at 717 W. 81s St., Stockton, California. <br /> 11 3. Defendant, in the course of Defendant's GASOLINE STATION activities, are pursuant to <br /> 12 Health and safety code section 25100 et seq., are hereby permanently enjoined from : <br /> 13 a. Disposing of, or attempting to dispose of, liquid latex paint in the land or into the <br /> 14 waters of the state, in violation of Health and Safety Code section 25217.1; <br /> 15 b. Storing hazardous waste onsite longer than one hundred eighty(180) days, in <br /> 16 violation of California Code of Regulations,title 22 section 66262.34(d); <br /> 17 c. Failing to label or marking containers used for on site accumulation of hazardous <br /> 18 waste, in violation of California Code of Regulations,title 22 section 66262.34(f); <br /> 19 d. Failing to maintain and operate facility to minimize the possibility of a fire, <br /> 20 explosion, or any unplanned sudden or non-sudden release of hazardous waste, in violation of <br /> 21 California Code of Regulations,title 22 section 66265.31; <br /> 22 e. Failing to keep containers holding hazardous waste closed during transfer and <br /> 23 storage, except when it is necessary to add or remove waste, in violation of California Code of <br /> 24 Regulations,title 22 section 66265.173(a); <br /> 25 f. Failing to manage universal waste batteries in a way that prevents releases of any <br /> 26 universal waste or component of a universal waste to the environment, in violation of California Code <br /> 27 of Regulations,title 22 section 66273.13(a); <br /> 28 g. Failing to label or mark the universal waste to identify the type of universal waste, <br /> 2 <br /> PERMANENT INJUNCTION AND FINAL JUDGEMENT PURSUANT TO STIPULATION <br />
