r M �2�t 0_6 0 <br />,7N <br />u3t�`r,,tt­r Cr,,,m�ol floe <br />August 29, 2014 <br />Ms. Margaret Quiroga <br />1547 Capitola Circle <br />Stockton, CA 95206-5818 <br />Dear Ms. Quiroga: <br />CERTIFIED MAIL <br />No. 7013 2630 0000 8026 9436 <br />SUBJECT: NOTICE OF VIOLATION; UNDERGROUND STORAGE TANK SYSTEM(S) AT <br />EL DORADO AUTO, 2070 S EL DORADO STREET, STOCKTON , CA 95206 <br />As part of an initiative by the State Water Resources Control Board (State Water Board) and the <br />U.S. Environmental Protection Agency (U.S. EPA) to obtain compliance at abandoned <br />underground storage tank (UST) facilities in California, you were issued a Notice of Non - <br />Compliance and Directive to Take Corrective Action at the Subject Site on November 14, 2013 <br />(enclosed). You were given sixty (60) days to comply. <br />To date, no compliance documentation has been received, nor any indication of when such <br />documentation is to be expected. <br />On December 20, 2013, you submitted a written response, stating you did not have financial <br />resources to remove the USTs located at 2070 S EI Dorado Street, Stockton, CA 95206. You <br />also stated you were willing to come into compliance by filling the USTs for closure in place. On <br />April 8, 2014, the State Water Board responded to your letter directing you to contact the San <br />Joaquin County Environmental Health Department to inquire about a permit to close the USTs <br />in place. If you are claiming financial hardship, please follow the steps listed in the enclosed <br />flyer, "Guidance for Tank Owners Claiming Financial Hardship", to determine if you are eligible <br />for assistance. Claiming financial hardship does not in any way relieve you from your obligation <br />to properly close the USTs. <br />Please submit compliance documentation to the State Water Board and your local Certified <br />Unified Program Agency (CUPA) to remove or abandon the USTIs in place, along with a <br />projected timeline to comply with the removal and sampling requirements. You are required to <br />obtain a UST closure permit from your CUPA before proceeding with UST removal or closure in <br />place. Your Site continues to be in violation of the following regulation, pursuant to H&SC <br />Chapter 6.7 and CCR Title 23, Chapter 16: <br />H&SC 25298 - Abandonment, Closing, or Temporary Ceasing of Operation of <br />Underground Storage Tank <br />You are required to correct any on-going violations and submit compliance <br />documentation to the State Water Board via the U.S. Environmental Protection Agency <br />and San Joaquin County Environmental Health Department within sixty (60) days from <br />the date of this letter. <br />
