The Survey may include a geophysical survey and tank <br />gauging, removing and analyzing contents of the USTs, and sealing the tanks. The Survey's <br />findings will help inform possible future site assessment or cleanup which may be needed. See <br />the Right -of -Entry form for more information about the permission requested. <br />We prefer that you submit the requested documentation electronically, in order to reduce paper <br />use, increase efficiency, and provide a more effective way for our staff, the public, and <br />interested parties to view documents in electronic form. However, if you are unable to submit <br />the documentation electronically, please send it to both mailing addresses listed above. <br />If you fail to respond to this directive within the respective timeframe identified above, the U.S. <br />EPA and/or the State of California may take action to conduct the required UST closure, site <br />assessment, and/or cleanup. If the U.S. EPA or the State of California incurs such costs, legal <br />action may be taken to recover the costs and/or place a lien on the property. <br />Failure to comply with this notice may result in enforcement action by the State Water Board. <br />The State Water Board reserves the right to bring an action against the owner and/or operator <br />of the tank(s) in violation, or it may recommend that the local CUPA pursue enforcement, or the <br />local CUPA may elect to pursue enforcement independently. Pursuant to Health and Safety <br />Code, Chapter 6.7, Section 25299, the owner and operator of the tank(s) are liable for a penalty <br />of $500 to $5,000 per tank, per day of violation.
