Margaret Quiroga sent a certified letter dated April, 4, 2001 in response to the Notice to Abate. <br /> (see attachment #9). In the letter, she alleged that the tanks had been taken out of service <br /> properly by the previous property owner. <br /> On April 12, 2001 Ms. Youngblood returned to the site and obtained permission from the <br /> manager,Alfonso Santana,to further investigate the tanks. Mr. Santana assisted Ms.Youngblood <br /> while she measured the depth of each tank through the fill tubes. Each tank measured to a depth <br /> of approximately 11'6". Photographs were taken (see attachment#10). From this investigation, <br /> Ms. Youngblood determined that the underground storage tanks on this property had not been <br /> properly closed prior to the implementation of the underground storage tank law, which requires <br /> that they were filled an inert material. <br /> Ms. Youngblood issued a letter in response to the letter from Margaret Quiroga (see attachment <br /> #11). This letter reiterated that Margaret Quiroga was to properly close the tanks immediately. <br /> The letter was sent by certified mail. Margaret Quiroga never signed to receive the letter. <br /> The tanks were not removed by the April 19, 2001 deadline originally given in the Notice to <br /> Abate. <br /> On May 21, 2001 Ms. Youngblood called Margaret Quiroga and asked why the letter had not <br /> been received. Ms. Youngblood verified the mailing address and told Margaret Quiroga that the <br /> letter would be resent that day. Ms. Youngblood also told Margaret Quiroga that she was one <br /> month past the deadline to remove the tanks. Ms. Youngblood said that the tanks would need to <br /> be removed immediately or other legal options would be explored. The letter was received at the <br /> Quiroga residence on May 23, 2001. (See attachment#12) <br /> On June 11,2001,Margaret Quiroga sent a letter in response. (See attachment#13) 'In that letter <br /> she claimed that she did not understand the abatement order and that the letter which was sent on <br /> April 12, 2001 did not explain it. <br /> On June 12,2001,Ms.Youngblood reviewed the letter with Doug Wilson, Supervising REHS. A <br /> letter was drafted in response (see attachment #14), and the decision was made to refer this case <br /> to the District Attorney's office for failure to properly close the underground storage tanks. <br /> On September 7, 2001, after reviewing the files for this site with Kasey Foley, Lead Senior <br /> REHS, and David Irey, Deputy District Attorney, Ms. Youngblood returned to the site to verify <br /> the presence and condition of a fourth tank on the property. Mr. Santana gave consent for the <br /> inspection and Ms. Youngblood confirmed that a waste oil tank was located at the southeast <br /> comer of the building and appeared to be full of oily water. Photographs were taken (see <br /> attachment#15). An Underground Storage Tank Program Inspection Report was issued and sent <br /> certified to Margaret Quiroga on September 18,2001 (see attachment#16). <br /> As of September 18, 2001, the four underground storage tanks on this property remain out of <br /> compliance. A permit to remove the tanks has not been submitted to the Environmental Health <br /> Division. <br /> Il.
