Heinz U.S.A <br />Dear Steve, <br />Thank you for discussing the circumstances related to the tank removal at the above <br />property with me today. I have been considering this tank removal with Jim Devenport <br />and Kevin Fitzpatrick from the Cranbrook Group over the past two years. It is our goal <br />to remove the 40,000 gallon tank, provide factory re -certification to prove its integrity, <br />and reuse the tank for storage of diesel fuel subject to the approval of Public Health <br />Services and implementation of the manufacturer's procedures for storage and <br />re -certification. Foster Farms is considering installing the tank at a site in Stanislaus <br />County pending regulatory approval and finalization of their plans. Stanislaus County <br />Department of Environmental Resources concurs with the use of a re -certified tank and <br />has tentatively approved its use subsequent to inspection and re -certification. We are <br />prepared to store the tank in a secured area onsite or at SEMCO's facility at 1217 South <br />7'" Street, Modesto, California, pending final disposition. <br />
