Costco Wholesale 1616 E. Hammer Lane, Stockton/2680 Reynolds Ranch Pkwy., Lodi
As stated in HSC 25290.1(c3), 25290.2(c3), "Secondary containment shall be
constructed, operated, and maintained to prevent any water intrusion into the system by
precipitation, infiltration, or surface runoff'. The EHD interprets this to mean that the
design and construction requirements for underground storage tanks installed on or after
July 1, 2004 shall be free of liquid or product. Concern is that liquid is being stored in
the STP sumps, and while there is a means of removing the liquid, this is not being
utilized by the owner or operator of the underground storage tanks, except during the
annual monitoring system certification testing. It is the EHD's belief that liquid should not
be stored in any sumps and for this reason the EHD will not rescind violation 316.
Concerning the replacement of spill containers when they fail:
The EHD recognizes the need to clarify what is meant by "spill container failure". If there
is a manufacturer's approved method to repair the spill container, then the spill container
does not need to be replaced. It is only when the spill container is no longer functional
that there is a need to replace the spill container as described above.
If you have any further concerns or questions, please contact me at (209) 468-9852.
Thank you,
fi✓ (/'1LrG2
Vicki McCartney, REHS
Senior Registered Environmental Health Specialist
2
