The EHD interprets this to mean that the <br /> design and construction requirements for underground storage tanks installed on or after <br /> July 1, 2004 shall be free of liquid or product. Concern is that liquid is being stored in <br /> the STP sumps, and while there is a means of removing the liquid, this is not being <br /> utilized by the owner or operator of the underground storage tanks, except during the <br /> annual monitoring system certification testing. It is the EHD's belief that liquid should not <br /> be stored in any sumps and for this reason the EHD will not rescind violation 316. <br /> Concerning the replacement of spill containers when they fail: <br /> The EHD recognizes the need to clarify what is meant by "spill container failure". If there <br /> is a manufacturer's approved method to repair the spill container, then the spill container <br /> does not need to be replaced.
