The permitting authority to install the tanks should be the same agency that closes them whether the tanks are
exempt from UST regulation or not. While that may not be the HazMat group, CUPA, it should be some
department of the County that has construction oversight.
I have never heard of a Regional Water Board the issuing construction permits for any building construction.
Construction permits are all done under local ordinances and the building code. It would be the same for
decommissioning the asphalt USTs, a construction permit to take them out or leave them in should be issued by
the county to ensure that the construction/abandonment requirements are met under local building construction
ordinance.
George
>>> Jim Barton 1/16/2008 11:27 AM >>>
Hi Margaret,
this morning Jim Munch and I discussed the asphalt tanks that you said were exempt under the definition of
USTs and not under your authority. Jim contacted George Lockwood, who referred the question to his staff,
Laura Chaddock (916.341.5370). Please contact Laura for discussion.
Hi Laura,
please provide a response to us concerning the LOP authority in relation to asphalt tanks and their closure in
place or removal. It is my understanding that the company has conducted an investigation (soil samples) and are
requesting a closure in place, no further action letter.
Thanks.
Jim Barton
James L.L.
