Soil profiling, off haul and disposal for up to 20 tons of <br />material will be done for an additional charge of $1,250.00. <br />Notes: <br />1. If any regulatory agency has additional requirements for the completion <br />of this tank removal project, other than the services outlined above, San <br />Joaquin County Community Development Dept. will be responsible for all <br />additional costs plus 207o. <br />2. During excavation, if the tank is found to have more than the normal 6' <br />concrete slab over it or an anchor slab under it and/or is encased in <br />concrete or damage from cave in occurs due to unstable soil conditions <br />In the tank area, additional equipment and time may be required to <br />complete the removal. Rental equipment, additional excavation time, <br />shoring, additional engineering, repairs, etc. may be required, materials <br />will be charged at cost plus 20%. Labor will be charged at $95.00 per <br />hour for two men. <br />3. We will not be responsible for repair of unknown or mismarked <br />underground obstructions encountered during excavation of the tank and <br />lines. If damage occurs, we will repair the damage on a time and <br />material basis. Materials are charged at cost plus 20%. Labor charges <br />are $95.00 per hr. for two men. <br />4. If residual material escapes from the tank during removal, due to poor <br />tank condition, owner is responsible for contamination caused by such <br />loss. <br />5. In the event additional work is required by the lead agency to excavate <br />contaminated material at the time of tank removal, we will perform the <br />work on a time and material basis. Additional excavation will be charged <br />at the hourly rate fitting the machine being used. All other services <br />(including additional backfill, plastic sheeting, etc.) will be charged at , <br />cost plus 20%. <br />6. Copies of all contractor related paperwork will be forwarded to the <br />owner and the proper agencies upon receipt of final payment in full. <br />7. In the event of any legal action or litigation to enforce or interpret any <br />term or condition of this agreement, it is agreed between the parties that <br />
