Hedding • San Jose, California 95112 <br />TELEPHONE (408) 947-7400 <br />Dr. James Allen <br />DEPARTMENT OF HEALTH SERVICES <br />Northern California Section <br />Toxic Substances Control Division <br />9250 Power Inn Road <br />Sacramento, Ca. 95826 <br />Dear Mr. Allen: <br />Throughout the past two months I have been discussing underground <br />closure plans with the San Joaquin County Environmental Health <br />Department, and was recently informed that flow through <br />underground tanks is not within their jurisdiction. The San <br />Joaquin County Environmental Health Department only regulates <br />non -flow through underground storage tanks and underground <br />petroleum tanks. I was referred to the State Department of <br />Health Services Toxics Unit by Dan Moe, San Joaquin County's <br />underground tank specialist. <br />Earlier today Duane Gelster, from the Permits Department, and I <br />discussed the proposed underground tank closure for our client, <br />INDY Electronics, in Manteca. Duane had no objections to our <br />proposal, but he advised that a letter regarding our discussion <br />be submitted to you. <br />INDY is very environmentally conscious and wishes very much to <br />comply with the regulations. INDY is considering removing the <br />tank, and replacing it with an above grade system. In September, <br />INDY submitted a variance application for the underground storage <br />tank and elementary neutralization unit, and is willing to work <br />with your agency in complying to the new underground tank <br />monitoring regulations. <br />INDY Electronics is a circuit board manufacturer with a 3600 <br />gallon underground wastewater recovery tank. The underground <br />waste recovery tank is located approximately 30 feet from the <br />rear of the building, and is of concrete construction, without <br />secondary containment. Furthermore, the tank was constructed in <br />1980, prior to the enactment of the Health and Safety Code <br />Division 20 Chapter 6.7 Sections 25289 and 25289.1 requiring <br />monitoring devises for underground tanks. The tank is buried at <br />a depth of 15 feet from the bottom of the asphalt, and is located <br />approximately 5 feet from the southwest property line. <br />
