No. There <br /> is no authority to waive such fees with two exceptions noted <br /> below. <br /> The fees for underground tank permits and inspections may be <br /> found in Health and Safety Code Section 25287 . That section sets <br /> forth the authority for local fees and surcharges that are for- <br /> warded to the State. Subdivision (a) of Section 25287 permits <br /> the waiver of fees for State and local governmental agencies when <br /> making an application for a permit for an underground storage <br /> tank. <br /> The other exception is that a local agency may waive a fee <br /> for underground storage tanks of 5 ,000 gallons or less located on <br /> a farm which contains motor vehicle or heating fuel used pri- <br /> marily for agricultural purposes if the local agency finds that <br /> the fee will impose an undue economic hardship on the person <br /> applying for the permit. In the second case, the local agency <br /> may not waive the State surcharge . <br /> Unless your fee schedule contains provisions for the two <br /> waivers set forth above, there is no authority for Environmental <br /> Health or the Board of Supervisors to waive fees. <br /> C:17AIVER <br />
