The constituent explained that they had purchased a home in the
early 1980's that included a gasoline pump and underground storage tank.
They never used the tank and other than Air Pollution Control ' s yearly inspec-
tions, they forgot about it.
Then, earlier this year they were contacted by the Environmental Health Divi-
sion and asked about the status of the tank and informed they owed past due
fees. At that time, they felt it would be in their best interest to simply
remove the tank. They applied to the Environmental Health Division for the
required permits and in addition to the regular fees were told again they
were liable for $600 in past due inspection fees.
At that time, they became frustrated in dealing with Environmental Health
Division and contacted our office. Being unaware of the intricacies of the fee
policies of the Underground Storage Tank Program, but knowing that waivers
have been granted in the past, we contacted the Environmental Health Division.
Rather than try to relay the information, we arranged for a meeting between
Mr. Valinotti , Donna Heran, the constituent, and ourselves.
At the meeting, Mr. Valinoti explained that under specific circumstances, le:
a person who can show an income derived from agriculture or someone who just
recently purchased property, a waiver might be possible, but under the cir-
cumstances described by the constituent, a fee waiver was not possible.
#1100-08.1
