The <br /> constituents agreed to move the tank and pay the $56 surcharge <br /> and S90 tank closure fees , but felt the remaining $600 of <br /> delinquent program fees should not have to be paid since they <br /> were not personally notified of the State regulations. <br /> Our Environmental Health staff first learned of the tank in <br /> May, 1990 , by way of a referral from the Air Pollution Control <br /> District stating an unregistered underground storage tank (UST ) <br /> was at 10306 S. Janet , French Camp. Staff confirmed existence of <br /> the tank under the driveway of the residence . State and local <br /> records indicate that the tank was not registered with the State <br /> {dater Resources Control Board by 7-1-84 as required by State law. <br /> It was also noted that the constituent had not used the tank <br /> since purchasing the property in 1981 . <br /> The constituents were advised that under UST Program regula- <br /> tions, that were effective in August , 1985 , their abandoned tank <br /> must be removed or closed under County permit and inspection and, <br /> before a tank closure permit could be reviewed and issued, local <br /> and State program fees must be paid. <br /> In addition to the above information , the following histori- <br /> cal information is pertinent : <br /> In 1983 , AB-2013 and AB-1362 were signed into California law <br /> requiring that all underground storage tank owners register <br /> their tanks with the State Water Resources Control Board. <br /> In 1984 , the notification and registration forms were dis- <br /> persed by petroleum distributors , petroleum suppliers, fire <br /> departments , the San Joaquin County Safety Council and <br />
