SMITH , DIRECTOR, HEALTH CARE SERVICES SUBJECT: REQUEST FOR FEE WAIVER OF UNDERGROUND STORAGE TANK PROGRAM Earlier this week, I spoke briefly with Brian Nessler regarding a constituent issue he had been pursuing with Supervi- sor Sousa and our Environmental Health staff . The issue related to a request for fee waiver of your Board' s previously estab- lished Underground Storage Tank Program. The amount in question was $600 representing four years of delinquent fees . Mr. Nessler felt that since the constituents had agreed to pay the State Surcharge of $56 and Tank Closure Fee of $90 and remove the tank, consideration of fee waiver would be appropriate. Mr. Nessler also indicated that we might consider fee waiver as an incentive to future tank removals . My initial response was that we must 1 ) be certain of both Departmental and County policy consistency in approaching all such requests ; 2 ) assess the financial implications since the program by Board policy is fee supported , and ; 3 ) assess the real and/or potential impact on other constituents who may have already paid such fees and what liability this might represent for the County. I spoke with Mr. Ron Valinnoti , Environmental Health Direc- tor, and asked him to provide additional background information.
