SMITH, DIRECTOR, HEALTH CARE SERVICES <br /> SUBJECT: CONSIDERATION FOR FEE WAIVER OF UNDERGROUND STORAGE TANK <br /> PROGRAM <br /> In October 1990, I corresponded to your Board in my memorandum <br /> of October 12, 1990, outlining our initial considerations regarding <br /> the above matter. Supervisor William Sousa, in his memorandum of <br /> October 19, 1990, expressed clarification regarding the concerns <br /> expressed by his constituent. We have concluded our research <br /> relative to the appropriateness of considering fee waivers of <br /> underSiound storage tank program and present here our conclusions . <br /> In our discussions with the County Counsel ' s Office, primarily <br /> Michael McGrew, Chief Deputy, we have asked him to clarify the <br /> legal position relative to considering a fee waiver at this time <br /> since the program is several years in existence. The attached <br /> memorandums from Mr. McGrew dated November 19 and December 20, <br /> 1990, clarify the legal considerations relative to fee waiver. <br /> In addition to the legal considerations, I asked Mr. Bill <br /> Mitchell, Deputy Director, and Mr. Ron Valinoti, Director of <br /> Environmental Health Services, to evaluate potential management and <br /> administrative concerns relative to fee waiver consideration. The <br /> results of our assessment indicate that we would not recommend <br /> consideration of fee waiver of the Underground Storage Tank <br /> Program. Based on County Counsel ' s opinion and our own research <br /> and professional point of view, we do not believe it would be <br /> appropriate for either our department or your Board to consider fee <br /> waivers at this time or for you to develop specific procedures for <br /> establishing fee waivers in the future. <br /> Post ffrce Box 1020 /Stockton / California 95201 / 209 468-6000 <br />
