On November 25, 1985, plaintiff filed with the <br /> California Secretary of State, in connection with the Judgment, a <br /> notice of judgment lien on personal property, as file no. <br /> 85290079 . <br /> F. On February 14, 1986 , defendant filed a Voluntary <br /> Petition under Chapter 11 of the Bankruptcy Code. This proceed- <br /> ing remains pending in .the United States Bankruptcy Court for the <br /> Eastern District of California as Case No. 986-00348 . <br /> G. The parties hereto wish to settle all disputes <br /> arising in, or in any way related to, the Action, including, but <br /> not limited to, all claims which were, or could have been, <br /> asserted therein, without the need for further protracted and <br /> expensive litigation. <br /> H. The parties hereto mutually understand that this <br /> settlement agreement and the releases contained herein pertain to <br /> disputed claims and do not constitute an admission of liability <br /> on the part of any party. <br /> NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL <br /> COVENANTS AND CONDITIONS HEREIN CONTAINED, THE PARTIES HERETO <br /> HEREBY AGREE AS FOLLOWS: I <br /> 1 .
