WEBER AVE, THIRD FLOOR <br /> STOCKTON CA 95202 <br /> (209) 468-0333 <br /> On September 2, 1997, 1 investigated complaint # 8917 regarding the removal of an <br /> underground storage tank (U.S.T.) without a permit at Taylor and Lower Sacramento <br /> Road in Lodi. At the time of inspection there was nobody visible in the structure or <br /> on the property at 15431 Lower Sacramento Road. I observed an U.S.T. on the <br /> ground, behind a structure. The U.S.T. measured approximately four feet in diameter <br /> and seven feet long. Adjacent to the U.S.T. was an excavation covered with sections <br /> of a wooden fence. The tank was constructed of steel and had three openings on the <br /> top of the tank. There was a moderate amount of soil on the exterior of the tank. <br /> I met an individual who identified himself as Ben Vanderheiden who lived at 681 <br /> Taylor. Vanderheiden was in his backyard that was directly west of this site. When <br /> asked if he had seen any activity around the location where the U.S.T. was visible, <br /> Vanderheiden explained how he saw someone on a backhoe around the area <br /> between 8:30 am - 9:00 am the morning of September 2, 1997. 1 told Vanderheiden <br /> about the permit requirements for the removal of U.S.T.'s. When I asked who the <br /> property owner of 15431 Lower Sacramento Road was, Vanderheiden explained how <br /> he thought it was owned by Katzakian. On the corner of Lower Sacramento Road <br /> and Taylor I observed a sign with the following information on it: The Prudential <br /> California Realty, (209) 951-2000 (1.3 acres, call Jerry Katzakian (209) 476-4205). <br /> 1 returned to the site shortly before 12:00 pm on September 2, 1997. 1 saw two <br /> individuals (Bill Lewellen and "Houston") in the area where I previously observed the <br /> U.S.T. I recognized both of the individuals from a permitted U.S.T. <br /> removal/installation project at 2420 Turner Road in Lodi. Lewellen took soil samples <br /> from the site on Turner Road and Houston was at the site while I was there for <br /> inspections. Lewellen was in the excavation with a shovel in his hand. A small hole <br /> had been dug in the bottom of the south side of the tank excavation. I told both <br /> individuals that I was investigating a complaint PHS-EHD received regarding an <br /> U.S.T. removed without a permit at this site. <br /> Lewellen explained how he was contacted to take a soil sample at this site where the <br /> U.S.T. was removed. Houston explained to me how he took out the tank and there <br /> was a hand pump connected to the U.S.T. I asked Houston "so you took out the <br /> tank?", he replied, " I took it out, I took it out." I asked Houston what his name was, <br />
