The Enforcing Officer hereby designates the following individual as his duly appointed Representative with respect to this Order: John C. Bird, R.G. Henshaw Associates, Inc. 11875 Dublin Blvd. Suite A200 Dublin, California 94568 925/551-7272 The Enforcing Officer's Representative shall be the Enforcing Officer's designee for oversight purposes under this Order. 8. Production of Documents. The Respondent may have information relevant to the Environmental Nuisance. Accordingly, within twenty-eight days of the issuance of this Order, Respondent shall produce to the Enforcing Officer's Representative the following documents: (a) any policies of insurance -- or if policies of insurance are not available, any evidence of policies of insurance (including invoices, correspondence, etc.) -- that may insure Respondent or any other part), for liabilities arising from the ownership or operation of the Property or any business, enterprise, or activity conducted on the Property; (b) any documents pertaining to the installation, modification,repair,filling, use, closure, or removal of any and all USTs on the Property; and (c) any documents pertaining to any discharge, overfill, spill, or release of any substance at or from any UST located at any time on the Property. 9. No Release from Liability. Nothing in this Order constitutes, a satisfaction or release from liability for any conditions or claims arising as a result of past, current, or fixture operations. Nothing in this Order shall limit the City of Lodi from taking any action authorized by law to protect public health, welfare, or the environment and recovering the cost thereof.
