carrying out the activities required in Paragraph 4 of this Order. Within five days of submitting the <br /> Proposal, the Respondent may, on request made to the Enforcing Officer's Representative, confer <br /> with the"Enforcing Officer regarding the Proposal. Following this opportunity to confer, the <br /> Enforcing Officer may modify the Proposal, as he deems reasonable to ascertain the nature and <br /> extent of the hazard, and approve the Proposal for implementation. <br /> 4. Required Activities. The Proposal shall contain a schedule that includes the following <br /> activities: <br /> (a) the collection of a minimum of two soil samples from the native soil immediately <br /> below each of the USTs proposed to be removed at the Property (Samples shall be collected <br /> from each end of each UST.); <br /> (b) the collection of a minimum of one soil sample from the native soil immediately <br /> below each twenty linear feet of underground piping leading to or from the tanks; <br /> (c) the collection of a minimum of one soil sample from the each area of potential <br /> contamination, if any, that becomes visible or apparent during field activities; <br /> (d) the field screening by headspace analysis using appropriate field equipment of all <br /> collected soil samples for the presence of petroleum hydrocarbons and VOCs; <br /> (e) the analysis of each collected soil sample by a California-certified laboratory for total <br /> petroleum hydrocarbons as stoddard solvent by Modified EPA Method 8015 and VOCs by <br /> EPA Method 8260; and <br /> (f) the preparation of a report summarizing the removal activities and the laboratory <br /> results and including detailed information on the condition of the tanks and piping upon <br /> removal, the nature and extent of any contamination detected, the location of such <br /> contamination(as illustrated on maps,figures, or tables),the results of all field sampling and <br /> laboratory analysis, any previous investigatory or remedial activities with respect to the <br /> USTs, and a historical summary of the operation and use of each UST (installation, <br /> substances stored in UST, known or suspected releases from UST, closure, etc.). <br /> 5. Implementation and Compliance. Upon notification of the Enforcing Officer's <br /> approval of the Proposal, Respondent shall implement and comply with the Proposal, as modified, <br /> if at all, by the Enforcing Officer. <br /> 6. Field Activities. No later than three days before initiation of any field activities under <br /> the Proposal, Respondent shall provide to the Enforcing Officer's Representative with written notice <br /> of the time and date of such activities. The Enforcing Officer, his Representative, or his designee, <br /> shall have the authority to enter and move freely about the Property at all reasonable times for <br /> purposes of reviewing the progress of carrying out the terms of this Order; conducting such tests as <br /> 2 <br />
