The site is located within the city limits. <br /> May 3, 1995 <br /> I received a phone call from a David Fisch asking if farm tanks could be <br /> removed without a permit. I told Mr. Fisch that farm tanks need a permit from <br /> the Fire Department before removal. <br /> Later the same day Captain Kuhlken, City of Stockton Fire Prevention (COS <br /> F.P. ) , called to tell me a Mr. Fisch had called him about farm tank fire <br /> permit. The UST to be removed was located on East Scotts Street in Stockton. <br /> I told Capt. Kuhlken the tank's status is in question and property owners need <br /> to provide proof that money was paid for agricultural crops or animals sold <br /> from this site. (CA Local Guidance (LG) letter - 13 4) <br /> Captain Kuhlken told me he would call Mr. Fisch and tell him to provide <br /> information to PHS-EHD on agriculture product produced on this site for <br /> determination of farm tank status. (LG - 109 5) <br /> I requested and received Mr. Fisch's phone # (209)467-6735 from Capt. Kuhlken. <br /> May 4, 1995 <br /> I received no phone call from Mr. Fisch or Captain Kuhlken so I phoned (209) <br /> 467-6735 and left a message for Mr. Fisch. Later, I received a phone call <br /> from #467-6735 stating this number was not for Mr. Fisch but for Diamond <br /> Walnut. I completed a Notice to Abate Immediately and submitted the Notice <br /> to Doug Wilson, Supervising RENS. <br /> May 5, 1995 <br /> I spoke to Doug Wilson about the action to take with this site. Doug Wilson <br /> told me a Notice to Abate immediately is not adequate. The site needs an <br /> Abatement Notice because it may be regulated. Also, an inspection of the tank <br /> is needed to verify the exact location of UST and type of UST. <br /> On my way to perform site UST complaint #CO003711 inspection at 2523 E. <br /> Scotts, I observed a blue pick up truck with a UST sitting in the back of it <br /> in front of the Scotts Street residence. The truck had Fisch Environmental <br /> Construction Services painted on the door. I spoke to the contractor, David <br /> Fisch, who was tightening the straps over the tank. David Fisch told me he <br /> had removed the tank at the request of the owner, Sherry Romero. I wrote the <br /> owner an Abatement Notice to register UST and obtain proper permits for tank <br /> closure. I knocked on the door; there was no answer. I placed the Abatement <br /> Notice on the door. (Owners Notice 2 B) <br /> May 5, 1995** I also wrote Abatement Notice to the contractor (Contractors' <br /> Notice 3 M) . He needs closure plan (approved) , fees, and contractors <br /> information on file. (Contractors' Information 3 0) <br /> Mr. Fisch took me onto the site. He had replaced the UST in its former <br /> location (east side of driveway) on top of back fill soils. The soils used <br /> for back fill were (a) from the site and (b) imported soil by contractor from <br /> an unknown source. <br /> My observations and experience told me this UST is not a farm tank because the <br /> land in this area has been residential for a long time. As per David Fisch, <br /> the UST is not a home heating fuel tank because there was no piping running to <br /> the house from tank. <br /> I saw the small the Bobcat used to remove the UST in the driveway. The tank <br /> had a window cut in one end and on the other end was spray painted #203H <br /> (Photos 1) . Mr. Fisch had placed the piping (approx 3-4 ft. ) on top of the <br /> UST. During my interview, David Fisch admitted he had not gotten the permit. <br /> 3 <br />
