Copies of hazardous waste disposal records for the past three years were not found on site. During an attempt to conduct a closure inspection on 8/22/2018, Max Lee, the following hazardous waste was observed on site and belonged to Valley Mountain Auto Service, Inc.: - Four 55 -gallon drums of used oil - One 200 -gallon tank partially filled with used oil - A blue parts washer sink partially filled with used oil - One 55 -gallon drum of used paper filters - One 55 -gallon drum of used oily absorbent - One 5 -gallon bucket of used oily absorbent Max Lee stated that he would apply for a temporary EPA ID number to properly dispose of the waste. However, on 9/6/2018, Max Lee informed the EHD that the business owner, Daniel Webster, took the waste off site and did not inform the property owner where he was going to take the waste, nor did Daniel provide manifests for the waste. Kristen Lee, the property's agent manager, stated Daniel took the waste about two weeks ago, which would be the week of August 27, 2018. Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have them readily available for review. Immediately locate a copy of all manifests and receipts for the last three years and submit copies to the EHD. This is a repeat violation, Class II. 117 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. An inspection was last done on July 10, 2018 and an inspection report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted by August 10, 2018. This information has not been received resulting in a non-compliant status for this facility. An operator that receives an inspection report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken. Ensure that a written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. This is a Class II violation. Overall Inspection Comments: Notes: - The business owner, Dan Webster, informed the EHD on 8/9/2018 that his facility was no longer in business. - The amount of hazardous waste generated in the past calendar year could not be determined due to disposal records not being on site. - An inspection was last done on July 10, 2018 and an inspection report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted by August 10, 2018. This information has not been received resulting in a non-compliant status for this facility. An operator that receives an inspection report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken.
